In sum, our Client was operating his E-Bike on the sidewalk adjacent to a Publix Supermarket in West Palm Beach. The accident occurred when suddenly and without warning a car ran a stop sign striking our Client causing him to fall off his E-Bike and hit the ground. He sustained injuries to his neck, back and other body parts requiring emergency medical treatment.
Instead of remaining at the scene for the Police to arrive, the at fault driver fled committing a hit and run. While our Client secured the tag number for the car that him, subsequent investigation by our office confirmed the at fault driver had an automobile policy with no bodily injury coverage.
Fortunately, the Client had automobile insurance with GEICO which had $10,000 in uninsured motorist (UM) benefits. We were quickly able to secure a tender of GEICO’s UM limits. The Client also had a Bicycle Accident Insurance policy with $25,000 in Vehicle Contact Protection coverage (which is similar to Uninsured Motorist Coverage) as well as $2,500 in Med Pay Benefits. Upon demand, the bicycle insurance carrier tendered its vehicle contact protection coverage of $25,000 and $2,500 in med pay benefits.
This matter was fully resolved in 4 months for the maximum available coverage. We are thrilled with the outcome as is the Client.
