Now On Your Side
Know Your Area
The city voted in 2019 to become the City of Lake Worth Beach. A much larger area west of the city still has "Lake Worth" mailing addresses. Your rights are the same either way, and so is your Lake Worth personal injury lawyer. What matters is where you were hurt and who caused it.
The historic downtown on Lake Avenue and Lucerne Avenue, the College Park neighborhood, Bryant Park on the Lake Worth Lagoon, the Snook Islands Natural Area, and the oceanfront Lake Worth Casino and William O. Lockhart Pier. Dixie Highway, Federal Highway, 10th Avenue North and 6th Avenue South carry most of the city's traffic.
Unincorporated Palm Beach County neighborhoods in ZIP codes such as 33461, 33463 and 33467, running west on Lake Worth Road past Congress Avenue, Military Trail and Jog Road. This is home to John Prince Park and the main campus of Palm Beach State College, next to Greenacres, Palm Springs and Lantana.

How We Help
Pick the kind of accident you were in to see how Florida law treats it.
Rear-end, left-turn and side-impact crashes on Lake Worth Road, Congress Avenue and the I-95 ramps. Our car accident guide covers PIP, fault and what a claim may be worth.
Lake Worth car accident lawyer →Uber's coverage changes based on whether the driver's app was running and whether a passenger was aboard. We sort that out for passengers, drivers and anyone hit by an Uber.
Lake Worth Uber accident lawyer →Lyft trips to the Tri-Rail station, downtown and the beach are common. A Lyft crash claim follows its own insurance rules, separate from Uber's.
Lyft accident lawyer →Box trucks, delivery vans and tractor-trailers move along I-95, Lake Worth Road and Dixie Highway every day.
A crash with a commercial truck can involve the driver, the trucking company and sometimes the company that loaded the cargo. Commercial carriers must follow federal safety rules, including limits on driving hours. Driver logs, onboard camera video and maintenance records can show what happened, but carriers do not keep them forever. We move quickly to request that this evidence be preserved.
Riders struck by drivers turning left across Military Trail, Jog Road or Lake Worth Road, or changing lanes into them.
Florida's PIP system covers vehicles with four or more wheels, so motorcycle riders generally don't get PIP benefits after a crash (§ 627.732(3)). Recovery usually comes from the at-fault driver's bodily injury coverage and from any uninsured motorist coverage the rider carries. Insurers often try to shift blame to the rider, so early witness statements and scene photos matter.
E-bikes and scooters share the road with cars on 10th Avenue North, Dixie Highway and the routes to the beach.
Florida gives an e-bike rider the same rights as a bicycle rider (§ 316.20655). Drivers must leave at least three feet when passing (§ 316.083(2)). Many e-bike riders have no insurance of their own, so we look at the driver's coverage, household auto policies and, when a battery or brake fails, the product's manufacturer or seller.
People hit while crossing downtown streets, waiting at bus stops on Dixie Highway or walking and riding along A1A by the beach.
A driver must stop for a pedestrian in a marked crosswalk (§ 316.130(7)). If you were on foot or on a bike when a car hit you, your own PIP, or a relative's PIP if you live with them, may pay the first medical bills. You can then pursue the driver for the rest of your losses.
Slips on spills, trips on cracked sidewalks, broken stairs and dark walkways at restaurants, condos, rentals and hotels.
When you slip on a spill or other foreign substance in a business, Florida requires you to prove the business was aware of the hazard, or that it sat there long enough that the business should have found and fixed it (§ 768.0755). Hotels and rentals can also be responsible for bed bug bites when they ignore an infestation.
Falling merchandise, forklift and slippery-aisle injuries at the stores on Lake Worth Road and Jog Road. Home Depot injury claims across Florida are a regular part of David's practice.
Home Depot accident lawyer →Spills, falling items, broken carts and parking lot hazards at Publix, Presidente Supermarket and other neighborhood markets around Lake Worth Beach.
Publix accident lawyer →Bites in parks, apartment complexes and on neighborhood sidewalks, often leaving scars that need follow-up care.
Under § 767.04, a dog owner is generally liable for a bite that happens in a public place, or on private property where the victim had a right to be. That's true even if the dog never showed aggression before. These claims are usually paid by the owner's homeowner's or renter's insurance. When the bite happens at an apartment complex, the property's insurer may be involved too.
If a careless driver or property owner causes a loved one's death, Florida lets the family bring a claim for what they've lost.
A wrongful death claim is filed by the personal representative of the person's estate on behalf of the survivors (§ 768.20). In most cases the family has two years from the date of death to file (§ 95.11(5)(e)). Spouses, children and other survivors may recover for lost support and companionship, and the estate may recover medical and funeral costs.

Local Knowledge
Lake Worth Beach packs a walkable downtown, a busy beach and some of central Palm Beach County's most heavily used roads into a small area. Most of our cases from here start on one of these roads:
Falls and store injuries cluster where people gather: supermarkets and big-box stores along Lake Worth Road, downtown restaurants and sidewalks, and the beach complex.
The Datny Difference
As a former litigation partner at a large national insurance defense firm, David learned how adjusters set reserves and look for reasons to pay less. He builds your claim with that playbook in mind.
Spanish is spoken throughout our office, and Creole and Russian translators are available when you need them. Tell your story in the language you're most comfortable with.
From the first call to the final check, David is available to you by phone, email and text message, supported by our paralegals and staff.
If you can't drive after the crash, we come to you at home or at the hospital, including HCA Florida JFK Hospital in nearby Atlantis. We can also meet by video.
From Home Depot falling-merchandise claims to Publix falls, David has represented store and property injury victims all over Florida.
David has practiced law for more than 18 years. He is admitted in Florida and New York and is a member of the Florida Justice Association.
Protect Your Claim
Florida Law
| Deadline to file | Most negligence lawsuits, including crash and fall cases, must be filed within two years (§ 95.11(5)(a)). Wrongful death claims also have two years (§ 95.11(5)(e)). |
|---|---|
| Fault | If a jury finds you more than 50 percent responsible for your own injury, you recover nothing. At 50 percent or less, your award is reduced by your share (§ 768.81(6)). |
| PIP after a crash | Your own PIP pays first, but only if you're treated within 14 days. Benefits reach $10,000 when a doctor finds an emergency medical condition; otherwise they stop at $2,500. PIP doesn't pay for pain and suffering (§ 627.736). |
| Falls in businesses | After a slip on a spill or other foreign substance, you have to prove the business knew about it, or should have caught it in time (§ 768.0755). |

FAQ
Yes. Many homes west of I-95 have a Lake Worth mailing address but sit in unincorporated Palm Beach County. Your mailing address doesn't affect your claim. What matters is where the injury happened and who was at fault, and we handle cases in both areas.
We don't have an office inside the city. We meet clients at home, at the hospital, by phone or video, or by appointment at our Wellington office at 1500 Corporate Center Way #1025 or our Boca Raton main office.
It depends on who owns or maintains the spot where you fell. A store, landlord or property manager may be responsible for a parking lot or walkway it controls. If a city or county sidewalk caused the fall, claims against a government body carry special written-notice requirements (§ 768.28, Fla. Stat.), so it pays to call early.
Keep the shoes and clothes you were wearing, unwashed, along with your receipt or card statement showing you were there. Save your photos of the spot and the names of any employees you spoke with. Ask for the incident report number. Store video is often recorded over quickly, so call us soon.
Yes, as long as you were not more than 50% at fault. Under Florida’s comparative fault rule (§ 768.81, Fla. Stat.), your recovery is reduced by your share of the blame, for example if you were looking at your phone when you slipped. Stores often argue a hazard was “open and obvious,” but that argument does not automatically end a claim.
Usually, yes. Under Florida law, a dog’s owner is generally liable when the dog bites someone in a public place or lawfully on private property, even if the dog had never bitten anyone before (§ 767.04, Fla. Stat.). Your recovery can be reduced if your own carelessness contributed to the bite.
Sí. Spanish is spoken throughout our office, and we can bring in Creole or Russian translators as well.
