In short, our Client was a seat-belted front passenger that was t-boned by another vehicle that ran a stop sign while traveling at great speed.
As a result of the impact, the host vehicle rolled over coming to rest on its side. The airbags deployed and the windows shattered. The Client was dangling by his/her seatbelt. Ultimately, the Client had to be removed from the vehicle by emergency responders.

While the Client had yet to fully recover, and treatment was ongoing, we sent a settlement demand to the at fault carrier for the full policy limits of $100,000. They quickly tendered the full limits. We then sent an underinsured motorist (UIM) demand to the host vehicle insurer for its policy limits of $100,000; they agreed to pay the full limits. Finally, we sent an underinsured motorist (UIM) demand to the Client’s personal auto insurer for his/her policy limits of $100,000 and they too agreed to pay.
Overall, in approximately 6 months, The Datny Law Firm was able to get a full recovery of $300,000 for our Client. This will ease the financial burden of his/her recovery, which is ongoing. The Client was pleased with the outcome and thankful he/she called The Datny Law Firm for help.
One of the major take aways from this case is not the amount of the settlement, which was substantial, but the fact there was underinsured motorist (UIM) benefits available to make it happen.
