How Florida law applies

What to Do After an Accident in Delray Beach
- Call 911 and wait for the police. Move to a safe spot nearby if you need to, such as the shoulder or a parking lot, but do not leave the area. Call 911 from there and wait for an officer to come to the scene and make a report, even if it takes a long time. The same goes for a hit-and-run. If you drive home and call later, or go to the police station instead of waiting at the scene, the agency may not take a report or investigate. The Delray Beach Police Department handles crashes on city streets, the Florida Highway Patrol handles I-95 and the Turnpike, and the Palm Beach County Sheriff’s Office covers unincorporated West Delray.
- Seek prompt medical care. Whether you were hurt in a crash, a fall, a dog bite or any other traumatic incident, get evaluated as soon as possible. Some injuries do not show symptoms right away, and delays in treatment give insurers an argument against you. Delray Beach’s hospital emergency room is at Delray Medical Center, 5352 Linton Blvd., a state-designated Level I trauma center. After a car crash, Florida PIP pays medical benefits only if you receive initial treatment within 14 days (§ 627.736(1)(a), Fla. Stat.).
- Report the accident right away. After a crash, get the report or case number and the officer’s name. After a fall in a store, restaurant or other business, ask the manager to write up an incident report before you leave, and get the manager’s name. Businesses rarely hand out copies, so take a photo of the incident report and of any document you are asked to sign. Failing to report promptly can cause serious problems in a car accident or fall claim.
- Photograph and video everything. Capture the hazard, the vehicles, the scene and your injuries, and get the names and phone numbers of any witnesses. The more the better. You cannot go back for evidence later, and what is not captured right away is usually lost for good.
- Preserve surveillance footage. Store cameras, restaurant and parking garage systems, doorbell cameras and other drivers’ dash cams often record over themselves within days or weeks. Note every camera you see near the scene so a written request to preserve the footage can be sent before it is erased.
- Be cautious with insurance adjusters. You have a duty to cooperate with your own insurance company, but that duty does not extend to the at-fault driver’s insurer or to the insurer for a store, supermarket or other business. When one of those adjusters calls for a recorded statement, they are not trying to help you. When they ask for your records, photos or documents, the goal is often to look for reasons to deny or reduce your claim, not to value it fairly.
