Hurt at a Publix in Boca Raton? Boca Raton Publix accident lawyer David B. Datny represents people injured at Publix supermarkets along Glades Road, Palmetto Park Road, Military Trail, Federal Highway, Yamato Road and State Road 7, and at Publix stores in Delray Beach, Boynton Beach, Deerfield Beach and throughout southern Palm Beach County. David has lived and practiced in Boca Raton for more than a decade, and his main office is a few minutes from most of the city’s Publix locations.
Publix is Florida’s hometown grocer, and it defends injury claims like a hometown company: quickly, with its own claims staff, and with store video that is often reviewed before the injured shopper has seen a doctor. If you fell on a wet floor, were burned at the deli counter, were hit by falling stock or were injured by a cart or a car in a Publix parking lot, the evidence that decides your claim is in Publix’s hands within hours. The sooner a lawyer sends a preservation request, the more of it survives.

Publix stores are spread across nearly every part of Boca Raton, and the shoppers in them change with the season. From November through April the aisles fill with winter residents and visitors; in summer the afternoon storms arrive on schedule and the entrances stay wet for hours. This page explains where those stores are, what tends to go wrong in them, the Florida law that governs a Publix injury claim, and how a Boca Raton case is handled from the first phone call to a settlement or a Palm Beach County courtroom.
Publix locations in Boca Raton sit in nearly every major shopping center in the city, from the beach to the Everglades edge of west Boca. Most of our clients were hurt at one of the stores along these corridors.
The stores near Federal Highway and the Fifth Avenue Shops serve downtown, the beachside neighborhoods and Florida Atlantic University. These are high-turnover stores with small parking fields, delivery trucks sharing the lot with customers, and heavy foot traffic from nearby condominiums, which raises the risk of cart and pedestrian collisions in the lot as much as falls inside.
The Publix stores clustered around Glades Road, Palmetto Park Road and Military Trail, including the Garden Shops at Boca Raton, draw shoppers from Boca West, Boca Pointe and the communities west of I-95. Many of those shoppers are older adults, and a fall that a younger person walks away from can mean a hip fracture or a shoulder surgery for a retiree.
Along U.S. 441 and Lyons Road, centers such as Mission Bay Plaza serve the large gated communities of west Boca. These are some of the busiest Publix stores in Palm Beach County, with long produce and dairy runs, in-store pharmacies and bakery and deli counters that operate at full capacity on weekends.
Between Thanksgiving and Easter the population of Boca Raton swells with seasonal residents, and the stores are busier than at any other time of year. Crowded aisles mean spills go unnoticed longer and end-cap displays get bumped and restocked in a hurry.
From June through September, daily thunderstorms leave entrance mats saturated and tile floors slick well inside the vestibule. Florida law does not excuse a store because it rained; the question is whether Publix put down mats, cones and warning signs and kept up with mopping while the weather lasted.
Boca Raton has a large retiree population. For an older shopper, the same wet floor produces broken hips, wrist fractures and head injuries that change daily life, and Publix’s claims staff will look for ways to attribute the injury to age or a pre-existing condition. We document your condition before the fall so the records show what changed.
Publix lots in Boca Raton open directly onto six-lane roads. Cart corrals, speed bumps, curb stops, crosswalks and lighting all matter when someone is struck by a vehicle or trips in the lot, and responsibility may be shared between Publix and the plaza owner. Our Publix parking lot accident page explains how those claims work.
Accidents at Publix supermarkets can happen anywhere, from the produce aisle and deli counter to the parking lot. Some of the most common injuries and hazards we see in Publix accident claims include:
Whether you were injured inside a Boca Raton Publix, in its parking lot, or in a collision involving a Publix delivery truck, The Datny Law Firm can help you understand your legal options and pursue compensation for your injuries.
Wet floors and spills. Section 768.0755 of the Florida Statutes requires an injured shopper to prove that Publix had actual or constructive knowledge of a transitory substance on the floor. Constructive knowledge can be shown by how long the substance was there or by how often the condition recurred. Store video, sweep and inspection logs, and the testimony of nearby employees are the usual proof.
Other hazards. For displays, fixtures, mats, carts and parking lot conditions, the general premises liability rule applies: Publix must keep the store reasonably safe and warn of dangers it knows or should know about.
Comparative fault. Florida uses modified comparative negligence (§ 768.81(6)). If you are found 50% or less at fault, your recovery is reduced by that share; if more than 50%, you recover nothing. Publix routinely argues that the hazard was open and obvious or that the shopper was looking at a phone, which is why photographs of the scene matter.
Deadline. Most negligence lawsuits must be filed within two years of the accident (§ 95.11(5)(a)). Claims involving a death have their own rules. Do not rely on the deadline; the store’s video is usually gone long before it.
Publix is not insured in the ordinary way for customer injuries. It handles claims through its own risk management and claims staff, which means the person who calls you works for Publix, not for an insurance company that may want the file closed. A Publix claims representative will usually ask for a recorded statement, request your medical records back for years, and make an early offer that covers little more than the emergency room bill. Everything you say is written down and used later. Once the firm is involved, that contact ends and the claim is handled through us.
Because Publix Super Markets, Inc. is a Florida corporation, a lawsuit filed in Boca Raton stays in state court. The case is filed in the Palm Beach County Circuit Court, part of the Fifteenth Judicial Circuit, and proceeds through discovery, depositions of store employees and mediation. Most cases settle; those that do not are tried before a Palm Beach County jury. David has prosecuted many Publix personal injury claims throughout Florida and has represented more than 1,000 injury victims.

Almost always state court. Publix Super Markets, Inc. is a Florida corporation based in Lakeland, so unlike claims against out-of-state retailers it generally cannot move a Florida lawsuit to federal court. A Boca Raton Publix case is filed in the Palm Beach County Circuit Court, part of the Fifteenth Judicial Circuit.
Not before you understand the full extent of your injuries. An early payment is often conditioned on a release that ends the claim, and many injuries from a fall, such as a torn rotator cuff or a herniated disc, are not diagnosed in the first days. Let a lawyer review the paperwork first.
Under Florida’s transitory substance statute, § 768.0755, you must show Publix knew about the liquid or should have known because it was there long enough, happened regularly, or was foreseeable. Store video, sweep logs, employee schedules and witness statements are how that is proven, which is why preserving them quickly matters.
Usually not on request. Publix treats store video as its own record, and a Boca Raton store manager will typically refer you to the company’s risk-management department rather than hand over footage. What you can do is have a lawyer send a written preservation request right away so the video from your visit is not recorded over, and the footage can then be obtained through the claim or a lawsuit.
