Orlando Publix Accident Lawyer
Yes. If you were hurt at an Orlando Publix because of a hazard Publix created, knew about or should have found during a reasonable inspection, you can pursue an injury claim against the company, whether you live in Orange County or flew in for a week at the parks. Orlando Publix accident lawyer David B. Datny handles claims for shoppers injured at stores from Lake Eola and Colonialtown to Dr. Phillips, MetroWest and Lake Nona. A claim turns on four questions: what caused the injury, who controlled that spot, whether Publix had notice of the danger, and what evidence still exists to show it.
Across Florida, David has prosecuted many personal injury claims against Publix and has represented over 1,000 injury victims, including many in Orlando and Winter Park over his career. He knows that Publix does not send these claims to an outside insurer; its own risk-management staff review the incident report, the video and your medical records, and decide early what position the company will take. David prepares for that from the first conversation, so the evidence Publix will rely on is matched by evidence of your own.
Our three offices have earned 140 Google reviews, and many of those reviewers mention that David returned their calls himself. FREE Consultation. No Win, No Fee. Call David 24/7 at 407-753-7474 or chat with us now.

Orlando Publix Stores and the Risks Around Them
Publix stores in Orlando range from a ground-floor market beneath a downtown condominium tower to large suburban anchors in West Orange and Lake Nona, and the setting shapes both how people get hurt and who may share responsibility. We handle injury claims arising at any Publix in Orlando and Orange County; the corridors below are where most of them begin.
Downtown, Lake Eola and Colonialtown
The Publix at The Paramount on Lake Eola, 400 E. Central Blvd., sits on the ground floor of a residential tower, and many of its shoppers arrive on foot or through a shared parking garage. To the east, the Publix at Colonialtown, 1500 E. Colonial Dr., draws steady traffic off one of the busiest roads in the city. Urban stores like these share sidewalks, garages and entrances with other owners, so a fall just outside the doors may involve a condominium association or building owner rather than Publix alone, and identifying who maintained that walkway comes first.
Dr. Phillips, Sand Lake Road, Kirkman Road and the Tourist Corridor
The Marketplace at Dr. Phillips, 7524 Dr. Phillips Blvd., and Kirkman Oaks Shopping Center, 4606 S. Kirkman Rd., on the corridor leading to Universal Orlando Resort, serve residents, hotel and theme park employees, convention crowds from the Orange County Convention Center on International Drive and vacationers stocking a rental condo for the week. Visitors in unfamiliar rental cars, crowded checkout lanes and constant turnover in the aisles create more spills and more close calls in the lot. These same roads feed Interstate 4, where Publix tractor-trailers are a regular sight, and a crash with one of those trucks is handled differently from a store fall; an Orlando Publix truck accident lawyer looks at the driver’s logs, the truck’s electronic data and the company’s dispatch records rather than a floor-cleaning log. Collisions with other commercial trucks around Central Florida are handled through our Winter Park truck accident lawyer practice.
West Orange: Ocoee, Winter Garden, Windermere and Apopka
West and northwest of the city, newer centers such as Lakeside Village Center, 7880 Winter Garden Vineland Rd. in Windermere, and The Shoppes at East Shore, 2411 Ocoee Apopka Rd. in Apopka, are built around wide parking fields and long walks to the entrance. Rapid growth around Horizon West keeps these lots full, and afternoon thunderstorms leave water pooling at curb cuts and doorways. Most of these centers are owned by a landlord rather than Publix, so the lease often decides who was supposed to fix a broken curb or a dark section of the lot.
East Orlando, Lake Nona and the Airport Area
The Publix at Lake Nona Plaza, 13900 Narcoossee Rd., and the Corner Lakes Plaza store, 16825 E. Colonial Dr., serve fast-growing neighborhoods along with medical-campus workers and travelers heading to or from Orlando International Airport. Publix’s own refrigerated distribution center sits just north of the airport runways, which adds truck traffic to the roads around these stores. Morning and evening rushes, delivery activity at the loading docks and floors mopped while shoppers are still in the aisles account for most of the injuries we see from this side of town.
Whichever part of Orlando your store is in, tell us the location and what happened, and David will start with the evidence that particular store and plaza are likely to hold.
What Causes Falls Inside Orlando Publix Stores?
Most falls inside an Orlando Publix start with something on the floor that a reasonable inspection should have caught, and what was on the floor usually points to how long it had been there and whose job it was to notice. The table below pairs the hazards we see most often with the evidence that tends to prove them.
| Hazard | When it shows up in Orlando stores | What helps prove it |
|---|---|---|
| Rainwater in the vestibule | Summer afternoon storms, when shoppers rush in from the lot and floor mats are already saturated | Weather records for that afternoon, mat placement, whether a cone was out and how often the entrance was checked |
| Spilled liquids in the aisles | Busy weekends and holiday weeks when vacationers fill the stores near the attractions | Video of the aisle before the fall, footprints or cart tracks through the spill, the store’s sweep schedule |
| Produce and floral water | Misted greens, flower buckets and loose grapes or berries near the produce tables | Photos showing debris or standing water, cleaning practices in that department |
| Leaking coolers and freezers | Dairy, frozen-food and seafood cases that drip or sweat in Florida humidity | Repair tickets for the same unit and mats or cones routinely left at that spot |
| Freshly mopped floors | Mopping during open hours with no sign, or a sign hidden behind an endcap | Whether a warning was visible from the direction you approached |
| Grease near the deli and bakery | Fried chicken, hot case and bakery counters during the lunch and dinner rush | Floor condition around the counter and how often staff checked it |
| Stocking carts, pallets and boxes | Restocking that runs into shopping hours in high-volume stores | Who left the cart or pallet and how long the aisle was obstructed |
| Broken glass and bottles | Sauces, wine and beer that break when they fall from a shelf or cart | Whether the area was blocked off and how quickly staff responded |
Florida law treats water, food and other liquids on a store floor as a “transitory foreign substance,” and our guide to proving a Publix slip and fall in Florida explains what has to be shown about Publix’s knowledge; when the water came from a leaking case, the guide also covers how a recurring cooler leak is proved. Knowing which hazard caused your fall is the first step toward finding the record that proves it.
Orlando Publix Parking Lot, Garage and Sidewalk Injuries
A large share of Orlando Publix injuries happen out in the lot or on the walk to the entrance, where the person responsible for the pavement is often a plaza owner or property manager rather than Publix. These are the outdoor conditions behind most of the cases we review:
- Potholes and crumbling asphalt in driving lanes
- Raised or cracked sidewalk slabs along the storefront
- Wheel stops placed in walking paths between cars
- Curbs and ramps with faded or missing yellow paint
- Water ponding at curb cuts after afternoon storms
- Dim or burned-out lot lighting after dark
- Garage ramps and stairwells at urban stores
- Runaway carts and damaged cart corrals
- Rental cars backing out of tight spaces
- Oil slicks and fluid leaks in parking spaces
If a driver struck you in the lot, the claim may involve automobile insurance as well as the property owner, and Florida’s personal injury protection rules apply. Our page on Publix parking lot and cart injury claims explains how responsibility is sorted out, and David can tell you quickly which companies belong in your claim. If the crash happened on the road rather than in a store lot, our Winter Park car accident lawyer page covers Central Florida collisions.
What to Do After an Accident at an Orlando Publix
After an accident at an Orlando Publix, get the medical care you need, report the injury before you leave and preserve what you can while the scene is still the way it was. Having handled many claims against Publix, David has seen how fast the evidence changes: the floor is mopped, the display is rebuilt, the cart goes back to the corral and the video system keeps recording over itself.
- Tell a manager before you leave the store. Find the store manager, describe what happened and request a written incident report. Note the manager’s name and the time. If you are visiting Orlando and leaving soon, make the report that day; it is much harder to do from another state.
- Photograph the cause and the surroundings. Take wide shots and close-ups of the spill, debris, mat, display or pavement defect, plus any cone or sign and where it stood. Photograph your shoes and any visible injuries. These images often matter most when Publix later argues the hazard had only just appeared.
- Collect names and proof of your visit. Ask witnesses for their names and phone numbers, and keep your paper or digital receipt. In a busy store near the attractions, a checkout time narrows down which video and which employees need to be looked at.
- Get checked by a doctor the same day. Many fall injuries, including wrist fractures, concussions and back injuries, feel manageable at first and worsen over the next day or two. The next section lists emergency rooms near Orlando stores.
- Be careful with calls from Publix. Keep any letters, emails or voicemails from Publix’s claims staff. Be truthful, but do not guess about how long a spill was there or who caused it, and speak with David before giving a recorded statement.
- If a vehicle was involved, protect your PIP benefits. If you were hit by a car in the lot, get the crash report number and the driver’s insurance, and receive initial medical treatment within 14 days, which Florida generally requires to use personal injury protection benefits.
Once your immediate medical needs are handled, call David at 407-753-7474. A short conversation early on helps you avoid mistakes that are hard to undo later.
Emergency Rooms Near Orlando Publix Stores
Orlando has several full-service emergency departments within a short drive of most Publix stores, and the right one depends on where you were hurt and how serious the injury is. For a head strike followed by confusion or vomiting, a suspected broken hip or heavy bleeding, call 911 and let paramedics decide where to go.
| Hospital | Area | Notes |
|---|---|---|
| Orlando Health Orlando Regional Medical Center | Downtown Orlando | Level I trauma center serving Central Florida |
| AdventHealth Orlando | Just north of downtown | Main AdventHealth campus, convenient to Colonialtown and Lake Eola |
| Orlando Health Dr. P. Phillips Hospital | Dr. Phillips and Sand Lake Road | Closest major hospital to the tourist corridor |
| Orlando Health – Health Central Hospital | Ocoee | Serves Ocoee, Winter Garden and West Orange |
| Orlando Health Horizon West Hospital | Horizon West / Winter Garden | Serves the newer communities southwest of Winter Garden |
| Nemours Children’s Hospital, Florida | Lake Nona | Pediatric emergency care if a child is hurt |
Make Sure the Medical Record Tells the Whole Story
Doctors write down what you tell them, so describe the accident itself: what you slipped or tripped on at the Orlando store, how you landed and what struck the floor. “Patient fell” says very little; “slipped on water at a supermarket entrance, landed on her left hip and struck her head on the tile” documents both the mechanism and the injuries. List each place that hurts, including aches that seem too small to mention, and keep your discharge papers, imaging reports, prescriptions and bills. If you are visiting from out of state, ask for copies before you fly home.
When your care is under way, call 407-753-7474 and David will review how the accident happened, who may be responsible and what our office does next.
How Publix Defends an Orlando Injury Claim, and How David Responds
A Publix incident report is not an admission of fault, and in most Orlando claims the company’s risk-management staff raise the same few defenses. David has seen them across many Publix cases, and the response to each starts with evidence gathered early.
“The spill had just happened.” Under Fla. Stat. § 768.0755, a shopper who slips on a transitory foreign substance must prove Publix had actual or constructive knowledge of it. Footprints, cart tracks, dried edges, a nearby employee or a condition that keeps recurring can show that it had been there long enough to be found.
“You should have seen it.” Store displays are designed to draw your eyes to the shelves, not the floor. Florida’s comparative fault statute, Fla. Stat. § 768.81, cuts the recovery by whatever share of fault is assigned to you and bars it entirely above 50 percent, so how the scene looked from your direction matters.
“Your injury came from something else.” Gaps in treatment and prior injuries are common arguments. Prompt care and a clear account in the medical record are the best answer.
“The landlord is responsible for the lot.” Sometimes that is true. We review the property and lease records and notify each company that shares control, so no one can simply blame a party who is absent from the case.
Knowing which defense is coming lets David collect the proof that answers it before it disappears, which is why an early call to 407-753-7474 matters.
How Publix Claims Are Handled in Orange County
Publix is self-insured, so an injury at one of its Orange County stores is adjusted in-house by Publix’s own risk-management department, not by a separate insurer.
The adjuster who calls you works for Publix and evaluates the claim on the company’s behalf. If the claim is not resolved, a lawsuit is filed in the Orange County Circuit Court, part of Florida’s Ninth Judicial Circuit, at the courthouse in downtown Orlando. For negligence claims that arose after March 24, 2023, the filing deadline is generally two years under Fla. Stat. § 95.11(5)(a). What happens once a case is filed is covered in our guide to how a Publix lawsuit moves through Florida courts.
When a shopping center owner may share responsibility, our office reviews deeds and recorded leases in the Orange County Comptroller’s official records and checks the Orange County Property Appraiser for the owner of the parcel, so the right companies receive notice.
Before any suit is filed, our office writes to Publix, and to the landlord or property manager when the records identify one, demanding that the video, the incident report and the maintenance logs be kept. Publix keeps its own files until a lawsuit is filed, so before suit we work from what you photographed, what witnesses saw and what our investigator records at the store; the company’s internal records are requested through discovery once the case is in litigation. The sooner those letters go out, the better the chance the evidence is still there.
Common Publix Accidents in Orlando
The Publix injuries we see from Orlando follow a few patterns. An Orange County Publix slip and fall is the most familiar, but the six below cover the situations we see most often, and each links to a guide on what that claim requires.
Slip and Fall
Storm water at the entrances and spills in crowded aisles near the attractions cause most Orlando falls. Learn the proof a Publix slip and fall claim needs.
Falling Merchandise
Shelves restocked for holiday and convention weeks in Orange County can leave heavy cases stacked high or poorly secured. See what it takes to prove a falling merchandise injury at Publix.
Hot Food and Coffee Burns
Delis feeding Orlando hotel workers and vacationing families pass hot soup, fried food and coffee across the counter all day. Read about Publix hot food and deli burn injuries.
Parking Lot and Cart Injuries
Rental cars, loose carts and drivers unfamiliar with the layout make Orlando plaza lots risky on foot. Find out who is responsible for Publix lot and cart injuries.
Publix Truck Crashes
Tractor-trailers from Publix’s refrigerated distribution center near Orlando International Airport run I-4, the 408 and the 417 to stores across Central Florida. Home grocery delivery is a different claim, since Publix delivers through Instacart, whose shoppers usually drive their own cars. Read our guide to Orlando-area Publix truck accidents.
Claims and Settlements
What an Orange County claim is worth turns on the injury, the course of treatment and the strength of the proof on fault. Read how Publix claims are valued and negotiated.
Whichever of these brought you here, call David at 407-753-7474; the store location and a short description of what happened are enough to get started.

Orlando Publix Accident FAQs
Can a tourist who was hurt at a Publix during a vacation pursue the claim after flying home?
Yes. A visitor injured at an Orlando Publix has the same rights as an Orange County resident, and you can work with our office by phone, email and Zoom once you are back home. Keep your medical records from wherever you were treated, along with your photos, receipt and hotel or rental records showing when you were in Orlando.
Does an Orange County Publix lawsuit stay in Orange County even if I live in another state?
Yes. Because the injury happened in Orlando, a lawsuit would be filed in the Orange County Circuit Court, part of the Ninth Judicial Circuit, in downtown Orlando. Much of the pretrial work can often be arranged around your travel, and many claims resolve before any filing.
What should I do first if a Publix tractor-trailer hits me on I-4 or the 408?
Get medical care within 14 days to protect PIP benefits, get the crash report number from the Orlando-area agency that responded, and photograph the truck’s markings and trailer numbers. An Orlando Publix accident lawyer then sends a preservation demand for the driver’s logs and the truck’s electronic data before they are overwritten.
Why does this page list a 407 number and a Winter Park address?
Orlando clients work with David through our Winter Park office at 3001 Aloma Ave., Suite 307, which is open by appointment, and 407-753-7474 is that office’s number. We do not have an office inside Orlando city limits, but Winter Park is close enough for in-person meetings, and much of an Orlando claim is handled by phone or Zoom.
My rental car was hit in a Publix parking lot. Does Florida PIP cover me if I live out of state?
Often, yes, but it depends on the policies involved. A rental car in Orlando generally carries Florida PIP through the rental company, and the rental agreement and your own auto policy determine which coverage pays first. The 14-day treatment rule still applies, so get medical care promptly and keep the rental paperwork.
Which stores does this page cover instead of the Winter Park page?
This page covers Publix stores in Orlando and the rest of Orange County outside Winter Park, including downtown, Colonialtown, Dr. Phillips, MetroWest, Lake Nona, Ocoee, Winter Garden, Windermere and Apopka. Stores in Winter Park itself are covered on our Winter Park page, and David handles both.
