To help you better understand how serious injuries occur at Home Depot stores, we have compiled a sampling of lawsuits filed against Home Depot in Florida. These cases illustrate the wide variety of accidents that can occur and the types of allegations commonly made against Home Depot in premises liability and negligence lawsuits.
Although slip and fall accidents remain among the most frequently reported claims, customers are also injured by falling merchandise, forklift accidents, unsecured displays, shopping carts, loading dock incidents, dog bites, parking lot hazards, and commercial truck accidents. Every case is unique, but many lawsuits allege that injuries could have been prevented had Home Depot properly inspected its premises, corrected known hazards, maintained the property in a reasonably safe condition, or followed appropriate safety policies and procedures.
The examples below are intended to demonstrate the types of claims that have been brought against Home Depot in Florida and the circumstances that can lead to a personal injury lawsuit. They are not intended to predict the outcome or value of any particular case, as every accident depends on its own unique facts, injuries, and evidence.
- Slip & Fall Lawsuit (June 2024): Stephen Levy filed a lawsuit against Home Depot in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County on June 3, 2024, for personal injuries following a slip and fall accident in the parking lot outside the store. Mr. Levy specifically alleges he slipped and fell on white painted crosswalk stripes that were wet from rain. According to the Complaint, the contractor, Rose Paving, who restriped and painted the crosswalks on behalf of Home Depot, failed to use non-skid slip-resistant paint and/or failed to use enough grit in the non-skid paint to prevent falls when wet. Home Depot knew or should have known of the hazardous slippery condition caused by painting the crosswalks with non-slip resistant paint, but according to Mr. Levy failed to warn customers or take any steps to avoid the serious risk of injury that resulted.
- Falling Merchandise Lawsuit (May 2024): Gustavo Frances filed a lawsuit against Home Depot in the Circuit Court of the 17th Judicial Circuit in and for Broward County for injuries sustained when a 125-pound door unexpectedly fell on his shoulder inside the Fort Lauderdale, Florida store (1000 NE 4th Ave.). - Slip & Fall (May 2024): Jose Ortiz filed a lawsuit against Home Depot in the Circuit Court of the 9th Judicial Circuit in and for Orange County for injuries following a slip and fall inside the store at 6130 E Colonial Drive in Orlando, Florida. - Slip & Fall Lawsuit (April 2024): Joseph Sparacino filed a lawsuit against Home Depot in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County on April 20, 2024, for personal injuries he sustained after he slipped and fell on a wet floor caused by a leaking roof at the store. Mr. Sparacino alleges Home Depot and the responsible property owner/manager were negligent in the ownership, inspection, maintenance, repair and control of the premises. Mr. Orasi alleges Home Depot was negligent in maintaining the premises in a reasonably safe condition and did not warn customers of dangers it knew about and/or should have known about.
- Employee Negligence Lawsuit (March 2024): Edanon Jones filed a lawsuit against Home Depot in the 9th Judicial Circuit in and for Orange County for injuries to the eyes when an employee carelessly swept a mixture of dirt, dust and concrete into his face. The Plaintiff seeks damages in excess of $50,000.
- Trip & Fall Lawsuit (March 2024): Allison Ramsay filed a lawsuit against Home Depot in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County for injuries following a trip and fall accident in the West Palm Beach, Florida store (220 South State Road 7). Specifically, the Complaint alleges Plaintiff was walking in the gardening section near the pots and plants when her left foot struck the corner of a loaded pallet that was protruding into the walkway causing her to fall. The existence of the pallet in the manner in which it was on the floor allegedly created an unreasonable risk of harm to the Plaintiff that Home Depot knew about or should have known about.
