Walmart was founded by Sam Walton in 1962 in Arkansas as a discount department store and grocery store. Since then the company has grown to a large multinational corporation that operates more than 10,586 stores and clubs in 24 different countries with over 4,606 in the United States and 387 in Florida including: Walmart Supercenters, Walmart Discount Stores, Walmart Neighborhood Markets, and Sam’s Clubs. In fact, Walmart is consistently one of the world’s largest companies by revenue as well as one of the largest employers in the world with over 2.1M employees. A typical Walmart store is from 100,000 to 200,000 square feet containing well over 1M different SKUs or products ranging from groceries, pharmaceuticals, electronics, home improvement products, tools and much more.

Considering the enormous size of the average Walmart store, the incredible volume of customers and employees that pass through the premises in a given day, as well as the millions of different products it offers to consumers that is stacked and stored high and wide, it is not surprising accidents with injuries do commonly happen to customers and employees.

Plaintiff further alleges there were no slippery when wet warning signs or safety mats near areas that were wet or known to be wet (e.g., entrance/exist, produce aisle, frozen food aisle, etc.)
  • Laceration Injury at Walmart (Boynton Beach): Plaintiff reached for a product on a shelf at Walmart in Boynton Beach, Florida, but instead of returning with the item, his finger was severely lacerated by an exposed knife that had been carelessly left there. What To Do After an Accident at Walmart in Florida?

One of the most frequently asked questions we get is what do I do after injuring myself at Walmart? To address this important question, we have prepared a brief to do list for you to save and follow should you ever need.

  1. Always report the incident to the store and make sure you complete a written incident report. Never leave the store without reporting the accident. Remember to take pictures of any forms you sign. While Walmart’s employees may promise to e-mail you the paperwork, if you leave the store without it, we will not get it.
  2. It is very important for all premises liability claims whether at Walmart or not to immediately take a photograph with your phone of the injury causing condition. If you slipped on water, get a picture of the wet area as well as the entire scene before it is cleaned up. If you fell on debris, get a picture of the same along with the entire aisle with witnesses if any. Whatever the cause of your accident, get pictures and/or videos. The more pictures and video the better. Make sure your photos/videos provide context so there is no confusions later exactly where in the store it took place. Do not erase the actual picture/video files from your phone as the same contains important meta data that is sometimes useful in prosecuting your case. Walmart does not always capture the accident on surveillance footage and even if they do, the store will not provide you or your attorney with a copy absent a Court order in litigation which makes your evidence even more valuable at the early stages of your case.
  3. Identify and gather contact information for any and all witnesses that saw your accident or the injury causing condition. It is important to not only get their names, but address, e-mail and phone information. If you fail to get that information after your accident, it may be lost forever. In all premises cases establishing notice is paramount and these witnesses will help us do just that especially if they can testify as to how/when the injury causing condition was created or, alternatively, how long it was there prior to your incident. For example, they may be able to describe how it looked such as old v. new, whether the condition was dirty or had footprints in it, if safety mats were present of missing, etc.
  4. Seek immediate medical attention after for your injuries whether at the Emergency Room or Urgent Care. Failure to timely document your condition, treat and otherwise get consistent care negatively impacts your ability to present a claim and suggests you were not injured or hurt even though there are many reasons why treatment is often delayed.
  5. Time is of the essence after a Walmart accident with injury. Evidence may be lost if not immediately safeguarded such as photographs, video footage, witness statements. If you wait too long, video may be erased, witnesses disappear and getting photographs of the condition becomes impossible if it has already been repaired or cleaned. Retaining a skilled and knowledgeable attorney like David B. Datny will make sure Walmart preserves all evidence and that we conduct an independent investigation on your behalf immediately.

What NOT To Do After an Accident at Walmart in Florida?

If you take one thing away from this article, please remember this WARNING. Walmart immediately starts investigating claims after the accident and gathering evidence and other information to minimize and/or deny your claim. They are not there to help you or to voluntarily provide medical or other benefits to you. The only way you are going to get anything from them is going to be through the legal process and after they are compelled to do so by a skilled and competent personal injury lawyer in Florida like David B. Datny, Esq.

For this reason, do not voluntarily give Walmart any statement after your accident, never admit fault as you may be missing information as to all the pertinent facts that impacts liability, do not sign a medical or employment authorization for Walmart, do not voluntarily undergo a medical examination by Walmart, do not accept a gift card or other nominal offer in exchange for a release. If you accept the offer, and sign the release, your case is forever over even if you later find out your injuries are more severe than first thought.
